TaxiDriver Posted November 15, 2011 Report Share Posted November 15, 2011 I have a guy who works for me on a self employed basis and today it looks almost certain he's diddled me by £30 or £40 today alone. He went out to do a job today priced at £140-£150 Rung up whilst on the job saying the person didn't want the return/hadn't asked for a return wasn't going to pay for the return journey, We agreed the price would therefore be £100. Tonight the customer phones up, compliments the driver on the job done but that the cab could have been cleaner, Now she says "Am I sure £130 is enough ? It seems cheap" insists the driver charged her £130 and she gave him £10 'for himself' He wont answer the phone but answered by text and insists that she only gave him £110, she's not dotty, and is friend of my next door neighbour so cannot see that she's anything to gain, in fact she's offered me another £30. "No he replies, I'm at home" trouble is the loud muzik was same tune playing in the pub I was parked outside :unsure: 2 days later I spoke to him face to face about his whereabouts and he lied to my face, even when I asked him to reconsider his reply, then I told him where I'd seen the cab, Suddenly !! he rememberes, thats where he parked when he went to do his daytime door security job & gets collected from & dropped off there. Alycidon Posted November 15, 2011 Report Share Posted November 15, 2011 If he is self employed then I believe you can simply dispense with his services without notice BUT you better check that with FSB, solicitor etc. If you cant then you have to prove the offence, this proof would have to stand up in court as you may well get sued for unfair dismissal. Take the lady's details, take a signed written statement from her, do this with a witness. As someone else said in 2 weeks set a trap with a friend, have the friend do a similar trip, ideally fit this person up with discreet sound/video recording gear. If he does it again and does not pay the money in after say a week then have him in, advise him that he is entitled to have a witness present, give him time to get a witness. Then advise that you are suspending him while you investigate a possible fraud. Advise that you will be holding a full disciplinary hearing in 2 weeks or once you have investigated fully. You also need a reliable witness who will take notes of who says what etc. Gather the info, in writing, hold the hearing, ask for a confession first up, if that is not forthcoming show your evidence, he will respond, you then make a fair decision based on the evidence. Beware that you may have to support this in a court of law. Some years ago I had a bright lad I knew was on the fiddle, took me 2 years to catch him and that was only after a manager who I had tipped off noticed something odd. I went through due process, he denied it, I sacked him. I think he stole somewhere between 20 and 30 K over the period. Problem was catching him and getting the proof, he was stealing stock and selling it for cash. No proof and you are a sitting duck at an unfair dismissal hearing, compensation and have to take him back on. Do it right and do it once. Why don't you tell him there's not much work that way u get rid of him without giving him the room to take u through a messy unfair dismissal claim.
