PErs were wetting themselves with excitement recently over a fresh no-hope anti-Brexit lawsuit brought by Remainiac MPs Tom Brake, Ben Bradshaw and Caroline Lucas. The Met Police’s lawyers have now responded to the legal threat, it doesn’t make pretty reading at all for the Remainers. Not that it’s stopping lawsuit-happy lawyers having a field day creaming cash from gullible Remainers on cases that have no chance of success…

First off they point out that the MPs themselves have no relevance to the case themselves – as required by law to actually bring the case. They then note that the Remainers’ expensive lawyers, Bindmans, have “not cited a single authority” where the courts have intervened in a police investigation in the way they want – by forcing them to bring a prosecutorial decision or hand over their entire investigation to the CPS within fourteen days. Politicians attempting to use the courts to compel the police in this way is truly extraordinary, this is real kangaroo court stuff…

However the people who’ll be squirming most reading it are the hapless Electoral Commission. The police lawyers list a truly remarkable catalogue of fundamental errors made by the UK’s electoral regulator:

“The proposed claim appears to be premised on the assumption that… when the EC referred those matters to the MPS it supplied all potential relevant documents… That assumption is incorrect…

“When the EC referred the matters to the MPS, the EC did not provide the documentation from its own investigation as your Letter of Claim asserts. Instead the EC required the MPS to make a request for disclosure pursuant to the Data Protection Act 2018 (a process that the MPS does not consider was necessary)…

“That documentation was not indexed or organised in what the MPS considered to be a systematic or logical fashion. The EC did not provide (and has not provided) the MPS with a comprehensive schedule of all used and unused material held by the EC from its investigation of the kind that the police would compile in a criminal investigation.

“The EC’s approach to the gathering and disclosure of evidence does not appear to the MPS to have complied with the letter or the spirit of the Criminal Procedure and Investigation Act 1996 and associated guidance…

“The MPS formed the view that EC has not disclosed all the documents in its possession or control that are potentially relevant to its investigation. The MPS has sought further disclosure from the EC on a number of occasions… The MPS remains of the view that the EC has not disclosed all of the documents in its possession or control that are potentially relevant to MPS’ investigation.

“Your letter of claim has only served to reinforce this view.”

This is a staggering indictment of the levels of pure unbridled incompetence at the heart of the quango that is trusted to be judge, jury and executioner of the UK’s electoral system. No-one in their right mind would hand such a bunch of rank amateurs yet more discretionary power over the UK’s democracy, the Tories are sensibly pushing back against it. Yet more evidence that the Electoral Commission is simply unfit for purpose…

Not a single one was on a ballot paper anywhere at the last EU elections, it’s a ragtag collection of undistinguished second-tier politicians unloved in their own countries and scandal-ridden appointees from the Davos circuit. Meet your new EU overlords:

European Commission President: Ursula Von Der Leyen. Who?

Daughter of a senior Eurocrat who was born in Brussels, she’s been German Defence Minister under Angela Merkel for five years. Her scandal-ridden stint in charge is widely regarded as a failure back home in Germany.

She thinks Brexit is a “burst bubble of hollow promises by populists”, supports a “United States of Europe” and is an enthusiastic cheerleader for an EU army, she even wrote about the importance of preventing “more democratic involvement” from “impeding Europe’s ability to act.” Nick Clegg eat your heart out…

It turns out she also plagiarised large parts of her doctoral thesis, but her university let her off as they said their had been no intent to deceive. She’ll fit right into Juncker’s shoes…

European Council President: Charles Michel

Former Prime Minister of Belgium who was ousted in a no confidence vote last December over a deportation scandal involving the dictatorial Sudanese regime. Naturally because it’s Belgium he’s still ‘interim Prime Minister’ more than six months later. He now gets rewarded for failure and doesn’t even have to move cities. Theresa May must be gutted she didn’t think of it first…

European Central Bank President: Christine Lagarde

Everyone’s favourite scandal-hit oompa-loompa is back, evidently the EU didn’t decide that being criminally negligent with €400 million of taxpayers’ money was a barrier to giving her the keys to the Central Bank.

She might actually have to take a slight pay cut from her whopping half a million tax-free a year from the IMF. Will she still be able to keep her delightful suntan topped up?

High Representative of the Union for Foreign Affairs: Josep Borrell

Spain’s pugnacious Foreign Minister and onetime European Parliament President has been embroiled in more scandals than Juncker’s had boozy lunches. He was forced to resign from the European University Institute over an undeclared €300,000-a-year conflict of interest. One insider tells Guido the board were just relieved to have any excuse to get rid of the worst president the EUI ever had…

He was fined €30,000 just last year for a “very serious breach” of insider trading rules on the Spanish stock market, his defence was that it was only 8% of his portfolio. I’m rich, it doesn’t matter!

He’s fiercely hawkish over Gibraltar, and also likes being highly aggressivewith journalists and innocent Catalan protesters. Makes Trump look diplomatic…

You didn’t vote them in, you can’t vote them out, in fact they can do pretty much whatever they like while living off hugely generous salaries and expense accounts funded by your taxes. EU democracy at its finest once again…

WATCH THIS - Lord Kerr who drafted Art.50. - and tremble

Crossbencher and writer of Article 50 Lord Kerr of Kinlochard says that if the UK leaves without a deal on October 31st, then there is "no prospect" of a "gradual transition". "I think everyone now accepts that the decision to start the Article 50 process was a revocable position," he starts, but adds that "there is no ladder back up the cliff" if the UK leaves without a deal, and the UK will have to rejoin the EU as a new member.

"In my view, immigration is the thing that keeps this country running. We native Brits are so bloody stupid that we need an injection of intelligent people, young people from outside who come in and wake us up from time to time."

I dont know where to start with that statement.

As well as tearing apart “private prosecutor” Marcus J. Ball for his comical attempt to bring a lawsuit against Boris over the £350 million a week figure, the High Court judgment also had something very interesting to say about the £350 million figure itself. Remain leaning legal commentators have ignored this bit of the Judge’s ruling:

“The alleged offence set out in the Application for Summons is that the Claimant “repeatedly made and endorsed false and misleading statements concerning the cost of the United Kingdom’s membership of the European Union”. It appears that if the Claimant had said/endorsed a figure of £350m per week gross, or £250m per week net, there would have been no complaint.”

As Remain and Leave campaigners well know, Boris repeatedly did make it clear during the referendum that £350 million a week was the gross figure. Here he is on GMB in June 2016 explaining in detail over several minutes how £350 million a week/£20 billion a year is the gross figure while £10.5 billion a year is the net figure, he’s also explicit about the distinction on Marr and in numerous other speeches including the big BBC debate just before the referendum. Boris did exactly what the judges said he should have done for there to be no complaint. Case closed. 
This is bound to upset a few Remoaners!

...and we are paying through the nose for these useless hasbeens falling asleep on their red leather seats.  If we have to have a second Chamber then let it be elected ....aahhhh !!!

Just thought, we the electorate put the others in the first Chamber and didn't do a terribly good job at that either.   Hmmmmmmm????

In news that surprised precisely no-one without severe Brexit Derangement Syndrome, the High Court resoundingly threw out the farcical anti-Boris lawsuit brought by smarmy “private prosecutor” Marcus J. Ball last month. The full judgment has now been released and it doesn’t make pretty reading for gullible Remainers who threw their money away on the crowdfunder. Hits them right in the Marcus J. Balls…

The case only got as far as it did because of a bizarre decision by a “District Judge”, in fact a lowly magistrate at Westminster Magistrates Court who was hopelessly out of her depth. The High Court judgment is absolutely scathing of both her decision and the case put forward by Balls’ legal team:

“The error of law… led the DJ to act in excess of jurisdiction and unlawfully by deciding to issue a summons whether the ingredients of the offence were not made out and which was outside the scope of the offence.

“Further, such an error of law necessarily involves a finding that no DJ properly directing herself… could, on the material before her, reasonably have found the offence made out…

“We are entirely unpersuaded by [Ball’s] argument…

“No authority was shown to us suggesting that the offence can be or has been equated to bringing an office into disrepute or misusing a platform outside the scope of the office.”

The judges then address the issue of whether the prosecution was vexatious. Ball hilariously tried to claim that his prosecution wasn’t politically motivated and went round deleting his old videos and websites in a vain attempt to cover-up the fact that he was indeed a massive Remoaner desperately trying to stop Brexit.

Unsurprisingly this didn’t fool the judges who list an entire catalogue of Ball’s bluster and make clear that they would have quashed the case on the vexatious grounds vexatious anyway, even without the serious legal flaws they had already identified. Amusingly they even include the interview where Ball said his “biggest responsibility” was to raise over £2 million as he had “run out of personal credit card and bank overdraft funding”. Ouch.

Incredibly, Ball is still saying that he wants to appeal the ruling despite his crushing defeat. Remainers surely can’t be stupid enough to give him yet more funding for his self-deluding fantasies… can they?

Announced today Jaguar Land Rover are investing £billions on gearing up to produce, in the UK, the full range of their cars.....in electric!

Strange how a couple of months ago remainers were blaming Brexit! For JLR laying off workers because of the downturn in their business.....and using this as a sign that UK plc was going down the pan!

It is now plain it had nothing to do with Brexit, but was due entirely to the government killing their business by demonising diesel powered motors......the fuel of choice for JLR.......

Hold on. JLR themselves cited failing sales in China, fears over diesel and uncertainty over Brexit as a part of the recent restructuring and right-down of assets they undertook in the UK.

The details around this announcement are lacking but it coincides with the government looking to invest a load more cash into innovation around batteries and electric vehicles.

It is indeed promising news but the Castle Bromwich plant is or will soon be on a four day week so JLR needed to do something to try to stimulate growth and investment. It really would not make sense to switch production of the XJ to another country whilst at the same time trying to scale up for electrication. Not out of the woods yet.

JLR are also making it clear that they need a managed Brexit in order to continue with long term operations in the UK.

The bottom falling out of JLR sales in China and across the world is entirely due to the Diesel issue, nothing to do with Brexit!.......JLR threw Brexit in as a makeweight/afterthought, remainers jumped on the bandwagon.....if JLR employees are on a four day week it's because of fall in sales due to the demonisation of Diesel......."if you ain't sellin cars you can't pay wages".....nothing to do with Brexit!

JLR will, it is reported, be closing the Castle Vale plant for 16 (?) weeks in order to install a new track etc geared up for the production of electric motors......what will happen to the workforce in that 16 weeks? Whatever happens to them it's nothing to do with Brexit!

Sorry but the issues with declining sales for JLR in China has next to nothing to do with diesel. Neither does it have anything to do with Brexit - I do not believe anyone was suggesting that, were they.

If you really don't accept that uncertainty over Brexit is a major concern for the manufacturing sector then this is frankly a pointless discussion.

It's not so much about the current plight but the fact that we have Brexit uncertainty makes it difficult for JLR executives to convince their board to invest / focus heavily in the UK operation as part of their restructuring and overall plan to address their problems. Not rocket science.

The problem with that statement is that you have to read it fairly carefully to understand its truth.
Most people see 'Falling sales' and 'Brexit' in the same sentence , and attach the two together as cause and effect.

When JLR s woes were made public, many in the remain camp, directly blamed Brexit immediately, (covered on this very thread BTW)  forcing JLR to issue this statement

No one is saying uncertainty  isnt hurting us, but again...
Put 'Brexit' and 'hurting industry' in the same sentence and most tie the two together as cause and effect, when really, if anyone is to blame for 'uncertainty' its our elected officials dithering.

Lets be honest, JLR have had a good run.
They sell a hugely overpriced product with questionable reliabiility, the fact that amongst others, the Chinese have woken up to this, isnt hard to get your head round.

No doubt they will produce, or are already producing a home grown version for this end of the market.
JLR will no doubt lick its wounds , and produce something else overpriced in the emerging EV market for us all to buy on PCP and pretend we own it .

We already knew it wasn't linked to Brexit!.....So you reckon the drop in JLR vehicle sales in China had "nothing to do with" the demonisation of Diesel? Then what do you put it down to?
