yesterday i won my SGC appeal at crowncourt

As is said, 'who dares wins', but the only problem is that that demands a modicum of moral fibre which you've obviously got by the bucket full. Superbly well done.

 

The downside of this is you have to ask who it is that is advising the police because all he/she is doing is making them look stupid and making you suffer.

Nice one, and very well done for taking the matter up. The police did not have a leg to stand on, and should have given your ticket back without wasting thousands of tax payers money on court cases and barristers fees! :rolleyes:

 

They bleat on about wanting to get more money from licence holders one minute and fritter money away the next. :no:

Well done you. You might be as well to contact the Cambridge Evening News about this so the injustice of having your SGC revoked is available for all to see. Too many times legitemate gun owners are villified by the press so would be nice to see a positive story come of this. Drop an email to the editor with a brief outline of the entire episode and see if he/she responds.

Not many have a story to tell like yours.

 

It is good that you got your sgc back but you will have to be cleaner than clean from now on to ensure that you keep it. Having been forced to give you your certificate back by the Courts the Police will be keeping an eye on you.

Reading this and although I am a member of BASC, I have just joined SACS as you never know when a scenario like this might arise and be in need of legal help.

 

 

All SACS members have £100,000 legal fees insurance cover as part of their membership, so you can relax in the knowledge that if something does happen, your case will be dealt with by expert solicitors at no cost to you, the member.

Give them a ring, Cambridge Evening News are always looking for a local interest story and it might do you a bit of good.

Congrats mate and well done for standing up for your rights.

 

Are your guns with a RFD or do the Police have them?

 

I believe there's been cases where the police have failed to return guns and the SGC holder has had to get a magistrates order to recover them

BASC's first action would always to get the permission of the member to contact the police on their behalf to get all the information, and then try and mediate with the police. If a case goes to appeal we do not automatically fund the appeal but will always make our experts available to help if you or your solicitor want .

 

Having said that, we are about to launch an optional extra legal expenses insurance policy for members to buy if they want to.

 

Regardless of this new legal expenses policy option funds have always been available though an ex gratia payment decided upon by the Chief Executive in conjunction with a small panel of specialist assessors including a specialist lawyer and in most cases a specialist barrister too, who will look at the file and assess the evidence that is available.

 

The cases is assessed in exactly the same way as it would be a legal expenses policy - the facts are assessed and based on the facts presented there has to be a clear case to appeal and a better then 50% chance of winning.

 

I accept that in the past this system may not have worked each and every time, and if you felt let down sixhills I am truly sorry and wish I could have got involved to try and sort it out. But it has worked in the vast majority of cases and with the new insurance package, the service will get better and better.

I'm glad to here that other members have challenged the police in what is another case of our Licencing costs being wasted.

I've just been assaulted :( a local idiot came up to my van and started hitting me through the window opening. He's bruised my face and neck and also caused £648 of damage to my van :(.

I wanted to prosecute but was informed we would both get arrested for a fray ??? As the cameras were blocked by his van and his wife who held my arm said I started it .

I never laid one finger on him as I was worried about my fac but I'm covered in bruises and cuts of his wife .

 

I sat down and cried

 

I don't fight ever but looked like if I prosecute I'd loose out

 

 

 

 

 

 

 

 

 

 

 

Glad you won at court

Basc told me id have to pay £3600 for a barrister if it got that far which does make me wonder what I pay for

TT , apart from me who did you talk to at BASC last week? I certainly did not mention £3600 for a barrister?

 

We do not fund cases where a member is prosecuted for a criminal offence, nor do we fund cases where a member wants to take a prosecution against another person.

 

Its important for all of us to realise that you can represent yourself at an appeal just as this chap has done, and the Bar Council have produced a large guide to help - see here:

Never the less, getting some specialist legal advise would always be a help, not least of all to get guidance on whether you do have a valid case for appeal in law or not. Clearly this chap did have a clear cut case and the police were in the wrong and that's exactly what the court saw and agreed

I can't remember his name that rang me sorry but he basically said if I loose my guns and want to appeal it would cost me.:(
