Air rifle destroyed by police - grounds for compensation?...

Hi guys. Does anyone have any legal experience of this sort of thing happening?

 

To cut a long story short a friend and neighbour of mine is going through a messy split with his wife. She's gone right off the rails, accusing him of all sorts including rape (she came home drunk and woke him up for sex, then can't remember it. She only reported it when they split and started discussing custody of the kids) and abusing the kids (he disciplines them, unlike her). All charges were dropped before they even got to court.

 

So, the police turned up and before speaking to him decided she was a high risk case. Once interviewed this obviously changed as he was able to provide evidence of how angry his wife was the last time he turned her down because she was too drunk - social media messages and texts have been a lifesaver! They took his air rifle but he's just been told that they destroyed it before the end of his case.

 

He's a bit miffed but is more worried about his kids for now. I think they overstepped the mark. It was a really good condition vintage rifle that had hardly been used. And it had sentimental value. Where does he stand? I think the whole situation stinks personally.

I think this is the wrong place to be asking, unless Mungler has experience of this.

Determining proof of ownership may be his first obstacle?

Would they/should they have provided him with a receipt? If not I'd be very inclined to let the Crime commissioner know that he intends do the officer/s for theft and sue the Force for compensation. Might just concentrate a few minds.

I agree, it doesn't seem right, but it may not be the official line.

My FEO also recently told me ( when I seperated from my partner of 30 years just after Christmas ) that the police have no automatic right to seize legally held firearms ( explaining why Durham handed back Atherton's ? ) in the case of spurious allegations from a spouse, but will try and persuade the owner to 'relinquish' them.

Oh it'll get messy. That we can be sure of!

 

I made the unfortunate mistake of making it clear that I overheard her on the phone telling him exactly why she was accusing him of rape, and it wasn't because she believed he had. That quite quickly resulted in an accusation of harassment being made against me (I text her asking what she was playing at) and the usual police visits etc... Luckily the police seem to have her tactics noted because of the number of people she's done it to! Mad to think I was babysitting her kids just a few months ago whilst they went out for meals etc so I'm hardly the intimidating neighbour she's trying to make me out to be. She will quite literally throw anything she can think of at anybody who questions her actions!

 

It'll come back to bite her. She's got very few friends left out of a huge number that as a couple they used to have. Life is going to be pretty hard for her from now on.

Unfortunately I was on the receiving end of a whole load of **** last year all engineered by my ex. All because I wanted to support my daughter even though I didn't want to be in a relationship with her mother any longer. The stuff that went on is farcical and I may actually write a book about it at some point it was that bizarre. Two things came of it firstly police force communication is so incredibly poor that the first west Mercia got the intelligence from dyffd Powys was 6 months after the event. The feo was a nice bloke but he told me that the first inkling of trouble and they remove guns without a second thought. BUT 6 months had passed and I seemed pretty normal. And the second thing was that women make false allegations against men all the time, in custody cases the allegations usually involve violence so that they qualify for legal aid. Sexual violence is their favourite. But because the CPS don't want real victims of domestic violence and rape/sexual assaults to feel like they can't come forward they will not prosecute women for wasting police time. They can't lose! An old air rifle is the least of his worries at the minute I think!

There is no need for a reciept as there is always a trail from property coming into possession to it going out.

From custody records to property found in the street.

If it's been destroyed I hope they have a signed declaration or audio tape of him surrendering it. If they don't then he will be compensated and any legal advisor can direct him in how to proceed. Or he could look at their website and email the forces legal department himself and start the ball rolling.

Shold they say they never had it and he says they did then it's a simple accusation of theft.

Air rifle aside, my friend went to court last week and was awarded 50% time with his kids. The gun has drifted into insignificance now. The magistrate gave her a very stern telling off, set access times rigidly and told her that if she ***** him around after everything she has done she could face a prison term! Result!

 

For me the best part was when the allegations on the child protection forms were brought up and she had to admit that all her allegations of abuse were false. Although it does beg the question why women are allowed to get away with such acts without any fear of comeback? She's admitted making false allegations, which in turn wasted police time and at the beginning would have been contempt of court surely? She should be nailed to a cross in a field somewhere, not let off....

On a slight tangent to this.

I have a large cabinet at my shop stuffed with guns and rifles that have been lodged for storage due to domestic unrest of one kind or another.

Some have had licenses revoked for the weakest of reasons.

One of my display cabinets is half full of shotguns for sale on a commission basis due to the loss of a license.

 

My advise to PW members in the event of domestic unrest is to get the guns and ammunition out of the house at the earliest/ safest opportunity and get them lodged securely with receipts.

I know of cases where the scorned woman has informed Police of armed threat on a date after guns have been lodged for storage.

Beware of the woman scorned!

A pal of mine had something similar. Armed police abused him and spat on him, he produced proof that the guns he had had gone a month prior... she got nothing for it either -.-

They physically spat on him? why?

How did they abuse him? :hmm:

 

Seems a bit extreme surely. 99% of the coppers I've met seem to be alright and are just doing their job. :|

A friend was seperating from his wife a few years ago but both still sort of living at the family home. We knew she had the ablity to bit nuts so he put his gun on my SGC and stored it at mine. Armed police turned up to remove his gun after he'd threatened her with it, he came back to the house opened the cabinet all that was inside was a reciept from me!

She got a bit of a telling off, he kept his SGC and now has a great new girlfriend.

Amazing what some women will do isn't it. I find some of these stories quite shocking. The police abuse being the key. I'm very surprised at that. He must have kicked off or had previous surely? I've never met a single abusive copper - a couple of right idiots, but never one I would consider unprofessional.

 

I've spoken with my FEO about her. He's suggested I have nothing to worry about, mainly due to the amount of accusations she's thrown and the number of people she's thrown them at in such a short space of time. I think perhaps her status as a credible victim is somewhat tarnished!

Spat on him digged him in the ribs and said 'your a big man when it comes to women' or words to that effect. She accused him of rape at gunpoint with his rifle. That's all I know on the matter except he has already handed his guns in a while before, never bothered with his fac since just has a shotgun now

 

Edit, I agree with the last bit, most I have met have been fine and had no issues at all. My uncles wife is a high ranking member of a local police force... she's brilliant :lol: think it was because of the allegations against him and they must have jumped the gun (excuse the pun)
